Volodymyr Yenich, the Partner of AVER LEX, shared his analysis of particular issues of sanctions litigation during the XII International Judicial Forum of Yurydychna Praktyka.

Among the most controversial issues are the issues of appealing against decisions on asset freezing sanctions, the practice of applying the sanction of asset recovery to the state revenue, and the sanctions policy outside the scope of judicial appeal.

Volodymyr also named 5 typical mistakes that may be made by the parties in sanctions proceedings: sanctions are not a form of liability; sanctions are not consistent with procedural actions in criminal proceedings; the grounds for sanctions must be substantiated; the connection of the sanctioned person with another person does not mean control over the assets of such person; sanctions restrictions are applied in the context of derogation from constitutional guarantees.
