AVER LEX lawyers secured the return of items and cash worth approximately UAH 7 million seized during a search
client request
The AVER LEX team successfully defended the interests of the Client in proceedings before the High Anti-Corruption Court (HACC) concerning the seizure of items and cash, totalling approximately UAH 7 million, confiscated by the National Anti-Corruption Bureau (NABU) of Ukraine during a search.
As part of a pre-trial investigation, NABU detectives conducted a search at the Client’s residence. Subsequently, the Specialized Anti-Corruption Prosecutor`s Office (SAPO) prosecutor applied to the investigating judge of the HACC, requesting the arrest of the seized funds to ensure their special confiscation, along with the seizure of property as material evidence.
The resulting result
After thoroughly examining the evidence provided by the lawyers, the court agreed with their position and concluded that the prosecutor’s allegations regarding the criminal origin of the funds seized from the Client were based on assumptions and were not supported by evidence.
Taking into account the professional approach of the HACC in fulfilling the objectives of criminal proceedings, the investigating judge rejected the prosecutor’s motion in full.
All seized items, material assets, and funds have now been returned to the Client.
