The cassation Administrative Court, as the highest judicial authority, supported the position of defence lawyers and the decisions of the previous two instances on the unlawful and groundless dismissal of Sergey Bochkovskiy. The court ordered reinstatement from the date of dismissal March 25, 2015.
A team of lawyers, under the leadership of Igor Fedorenko (a Partner of AVE LEX) and Vladimir Enich (a lawyer of AVER LEX), developed and implemented an algorithm to protect the client. Due to the evidence provided by the defence, Order of The Cabinet of Ministers of Ukraine dated March 25, 2015, that the dismissal of Sergey Bochkovskiy from the Head of the Emergency Service of Ukraine and the corresponding Order of The State Emergency Service were found unlawful.
The resulting result
The Cabinet of Ministers of Ukraine has not yet implemented the court decision and has not reinstated Sergey Bochkovskiy. Therefore, the lawyers initiated the introduction of information on the commission of a crime in the Unified Register of Pre-trial Investigations. They also initiated investigative and procedural actions regarding omissions of State officials by the State Bureau of Investigations.
A pre-trial investigation is still continuing.
